All you have to do is take one look at the way Kim Foxx handled herself throughout this whole thing, and you’d have to recognize that none of what you’re about to read is surprising in the least.
Essentially, Jussie Smollett had his own defense attorney heading up the state’s attorney’s office, which means she was able to make phony promises to the police in order to get them to back off the investigation, only to come back later and stab them in the back so her client could go free.
Foxx was Smollett’s patron in this whole thing. That’s why she was trying to convince the Chicago police, at the rest of Michelle Obama’s BFF, to turn the case over to the FBI. That’s why she claimed to recuse herself from the case but didn’t really. And that’s why she offered the weird claim that, hey, no one prosecutes Class 4 felonies.
Detectives wrote: “Investigation revealed that a plan was formulated and put into play by SMOLLETT to conduct a staged incident where SMOLLETT was beaten by — brothers’ names redacted — posing as persons other than themselves.”
“How can any individual embraced by this city turn around and slap everyone in this city in the face by making up these false claims?” said Chicago Police Supt. Eddie Johnson back on Feb. 21.
The best way to understand weird behavior is to consider contexts in which the behavior might make sense. Does anything Foxx did make sense if she is a serious prosecutor? No. Nothing.
Does it make sense if she was just trying to protect Jussie Smollett? Yeah, then it makes perfect sense.
And the police aren’t about to let it go, apparently because the files they’re releasing show that Foxx had told police she would defer Smollett’s sentencing in exchange for an admission of guilt. That was apparently acceptable to the police, who did a lot of hard work to gather the evidence proving Smollett’s guilt.
But then Foxx turned around and stabbed them in the back, having a judge seal all the files and simply dropping all charges – with no admission of guilt or anything else required. To this day, Smollett still insists he was attacked by Trump supporters screaming, “This is MAGA country.” Everyone knows it didn’t happen, but the official disposition of the law is that he did nothing wrong.
I think Chicago police have decided that Kim Foxx needs to pay for this with the complete destruction of any professional credibility she might have left, and it’s hard to argue with them. A person this dishonest and irresponsible should not be a state’s attorney, and if they make it as difficult as possible for her to stay in the position, the people of the State of Illinois will benefit.
And Lord knows, if you live in Illinois, not much happens in the governmental world these days that benefits you. They should be thankful for this one small favor.
