Former (thank goodness) President, Barack Hussein Obama, was aware, for a long time, that his National Security Agency (NSA) was intentionally intercepting the private communications of American citizens, in violation of the Constitution and of a Federal Court order.
AND HE DID NOTHING ABOUT IT!
The Foreign Intelligence Surveillance Court called the unconstitutional actions of the NSA under the Obama Administration “a very serious Fourth Amendment issue.” If you’re interested, you can find the Court’s Memorandum Opinion and Order here.
As explained in detail by the National Review, “[e]ven if the NSA does exactly what it is supposed to do… American communications are being seized and subjected to an inspection — however cursory — in the absence of any warrant, probable cause, or foreign-intelligence relevance.”
The Fourth Amendment to the Constitution protects American citizens from unreasonable search and seizure. But the NSA under the Obama Administration, routinely violated this by running “identifiers” of regular American citizens, things like their telephone number or email address, through searches in their upstream database.
Thankfully, the Trump Justice Department proposed a tightening of how and what the NSA can search, and the Court approved. Now, at least one end of the communication must be from outside the United States.
Why is it that the liberals are oh so upset about any talk by Trump of a travel ban to protect American’s citizens, yet I’m sure they would argue that they were just trying to protect America, while violating our Fourth Amendment rights? A good question, huh?
